It's legal to carry it, which doesn't really matter 'cause -- get a load of this -- if the cops stop you, it's illegal for them to search you. Alaska Supreme Court: Constitution Protects Adult Pot Use

Despite tremendous pressure from Drug War supporters, the Alaska Supreme Court last week upheld a September 2003 Court of Appeals finding that the possession and use of up to four ounces of marijuana by adults within the home is protected by the Alaska constitution's defense of citizen privacy.

In response, angry drug warriors are preparing to ask the Alaska state legislature to amend the Alaska constitution to remove protection for marijuana use.

But anti-prohibition forces are moving forward -- in a big way. The November Alaska ballot will feature a bold initiative to remove *all* criminal and civil penalties on the use, possession, cultivation, or distribution of marijuana by adults over 21. The state legislature specifically would be called upon to regulate marijuana like alcohol.

If this initiative succeeds, it will be, according to Rob Kampia of the Marijuana Policy Project, "the first of its kind in the world. Even Holland has penalties for marijuana, although they are rarely enforced."

A 2003 Zogby poll found that 41% of Americans agreed with the statement that "the government should treat marijuana more or less the same way it treats alcohol: it should regulate it, control it, tax it and only make it illegal for children."
